Effective December 1, 1999, the leave policy for the titles listed will be amended as contained in this memorandum:

Vacation Leave
- The vacation accrual
schedule will be as follows:

- A maximum balance
of 42 days will be established. This will include accruals credited each
May 1 and any time remaining to the employee's credit as of April 30.
Each May 1, any vacation time which exceeds the 42 day limit will be
transferred to the employee's sick leave bank.
- Each May 1, employees will be credited with 2 Person
Holidays
- Employees will be entitled to the following holidays: New Year's Day, Martin Luther King's birthday, Presidents Day, Memorial Day, Independence Day, Labor Day, Veteran's Day, Thanksgiving Day, Day after Thanksgiving, Christmas Day.
Leave Policy - Non-managerial, Non-represented Operating Supervisors Revised
Sick Leave
- An employee who qualifies with ten (10) years of MTA service will, upon separation, be paid half the accumulated sick time up to 240 days (120 full days).
Lump-Sum Payment
- Upon separation, all
vacation, sick, compensatory (OTO) and AVA entitlements will be handled
in a lump-sum, non-pensionable payment following removal from the payroll.
Lump-sum payments will be capped at the amount of the annual salary.
- Employees are limited
to a usage of 35 vacation days in their last year of service prior to
separation. If an employee uses more than 35 vacation days in the last
year, the excess will be deducted from the lump-sum payment.
- In calculating the lump-sum payment, employees will be credited with up to a maximum of 54 vacation days (inclusive of current and accrued time).
Leave for Death in Family
- At the time of death in an employee's immediate family, he/she shall be granted up to four (4) working days. The definition of immediate family remains unchanged.
Overtime
- Work beyond 40 hours
will be paid at the rate of time and one-half to a maximum of $85,000
in annual earnings.
- All waivers to the
overtime cap will require Presidential approval.
- Employees who have
reached the overtime cap shall accrue compensatory time, hour for hour,
to a maximum of one hundred and sixty (160) hours.
- Employees who have reached both the overtime dollar cap and the compensatory time limit may be required to work additional hours beyond 40 without additional compensation.
